Membership Terms, Legal, and Privacy Agreement
1. Membership Terms & Conditions
1.1 General Membership Obligations
Memberships at Carolina Pickleball Club (CPBC) are non-transferable and non-refundable, except where explicitly stated in this agreement. By becoming a member, you agree to adhere to all rules, policies, and guidelines set forth by CPBC, which may be updated periodically at CPBC’s discretion.
1.2 Membership Tiers
Membership options are available at each club. Specific benefits associated with each tier are available upon request. CPBC reserves the right to modify membership benefits with prior notice.
1.3 Payment Terms
Membership fees must be paid in full upon registration. Monthly or annual payment plans are available and must be maintained in good standing. Late payments may incur a penalty fee as specified in the fee schedule. Membership requires either a 1-year pay-in-advance contract (at a discounted rate) or a month-to-month contract without any lapses in payment. All members are responsible for paying their membership dues on time. In the event that your membership expires due to a lapse in payment of monthly membership dues for longer than 15 days, you will be required to pay a $100 reinstatement fee and rejoin at the current rate.
1.4 Advance Reservations
Court reservations may be scheduled in advance, based on membership level. For example, certain membership tiers may allow reservations up to 14 days in advance. Specific details are provided in the membership documentation.
1.5 Guest Fees and Policies
Guests of a member are allowed a limited number of visits per year before requiring membership. This is specific to an individual, regardless of how many different members they may attend with. Guest fees are applicable per person, and members are responsible for adding their guests to their court reservation and paying the guest fee ahead of time online.
1.6 Membership Suspension & Termination
CPBC reserves the right to suspend or terminate memberships for non-compliance with facility rules, non-payment, or behavior that disrupts the community atmosphere.
1.7 Full Membership Terms
Membership terms are subject to updates and revisions by CPBC. Members will be notified of significant changes via email or announcements on our website. Membership benefits, pricing, and access are as described in the membership documentation provided at sign-up. Continued use of CPBC facilities constitutes agreement to the latest terms.
2. Facility Usage Policies
2.1 Access & Hours
Members have access to CPBC facilities during operating hours, as posted. Special events may require additional fees or reservations.
2.2 Conduct & Safety
All members must conduct themselves respectfully toward staff and other members. Unsafe behavior, harassment, or vandalism will result in immediate suspension or termination of membership.
2.3 Cancellations/No-Shows
In the event of a needed cancellation, members are expected to cancel court reservations via the designated reservation system or by contacting the front desk prior to the reservation start time. Cancellations must be made 4 hours or more prior to the reserved time to avoid a no-show penalty. Members that do not cancel or show up for their scheduled reservation will be assessed a no-show fee.
2.4 Liability Waiver
Members participate in activities at CPBC facilities at their own risk. CPBC is not liable for personal injury, property loss, or damages incurred during facility use. By signing up for membership, members agree to release and hold harmless CPBC, its staff, and affiliates from any claims or liabilities arising from participation in club activities or use of its facilities.
2.5 Assumption of Risk
Members acknowledge that pickleball and related activities carry inherent risks, including but not limited to physical injury or property damage. Members voluntarily assume all risks associated with participation.
2.6 Property Responsibility
The facility is not liable or responsible for any lost, stolen, or damaged property, whether from lockers, vehicles, or other locations on the premises. Participants are advised not to bring or store valuables on the premises.
2.7 Photo and Media Policy
Members acknowledge and agree that photos or videos may be taken during activities or events at CPBC facilities. These photos or videos may be used for promotional purposes, including but not limited to social media, marketing materials, and website content. If you do not wish to be included in such media, please notify staff in advance.
2.8 Dress Code
All participants (members, visitors, players, and observers) are required to dress appropriately and respect the facility’s dress code before entering and throughout their visit.
2.9 Personally Operated Activities
Members may not organize their own informal or formal sports leagues, tournaments, or programs within the facility. Teaching private or personal lessons in the facility is also prohibited unless authorized.
2.10 Wireless Network Usage
By accessing the facility’s wireless network, you agree not to use it to transmit any material that violates any applicable laws. The facility may block access or terminate the wireless service at any time and for any reason and assumes no liability for doing so. Information about your usage of the network may be recorded and used or disclosed when appropriate to comply with the law or to protect the rights, property, or safety of the facility.
3. Legal Disclosures
3.1 Governing Law
This agreement is governed by the laws of the State of North Carolina. Any disputes arising from this agreement will be subject to the jurisdiction of courts located in Hickory, NC.
3.2 Arbitration Clause
In the event of a dispute, both parties agree to resolve the issue through binding arbitration in accordance with the rules of the American Arbitration Association.
3.3 Force Majeure
CPBC is not responsible for interruptions in services due to events beyond its control, including but not limited to natural disasters, pandemics, or government-imposed restrictions.
3.4 Indemnification
Members agree to indemnify and hold harmless CPBC, its staff, and affiliates from any claims, damages, or expenses arising from their use of the facilities or participation in activities.
3.5 Injuries
If you are injured while in the facility, please seek immediate assistance from a staff member. The facility is not responsible for, nor will it consider reimbursement of, member medical costs, including charges a member may incur for emergency response services, ambulance, etc., in the case of a medical event or emergency that occurs on the premises.
4. Privacy Policy
4.1 Information Collection
CPBC collects personal information during registration, including name, contact information, and payment details. This information is used solely to provide services and manage memberships.
4.2 Data Protection
Your personal information is stored securely and will not be shared with third parties without your consent, except as required by law.
4.3 Communication Preferences
Members can opt in or out of receiving marketing emails and updates. Operational communications, such as billing notifications, will be sent regardless of opt-in status.
